Welcome to Breesy. These Terms & Conditions (“Terms”) govern your access to and use of Breesy’s website, platform, and services. By accessing or using Breesy, you agree to these Terms. If you do not agree, you must discontinue use of the Services.

 

1. Acceptance of Terms

 

By creating an account, subscribing to Breesy, or interacting with the platform, you agree to comply with these Terms and all applicable laws. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business.

 

2. Services

 

Breesy provides an AI-powered communication platform that includes call answering, lead triage, message routing, scheduling, workflow automation, transcripts, and integrations with authorized third-party systems. Breesy may update or modify features at any time to improve performance or security.

 

3. Customer Responsibilities

 

Customers agree to:

• Provide accurate business and contact information
   

• Maintain the confidentiality of login credentials
   

• Ensure lawful use of the Services
   

• Comply with call-recording consent laws
   

• Ensure data they provide is accurate and does not violate third-party rights
   

• Manage permissions for their users and integrations
   

• Use Breesy’s AI ethically and responsibly
   

Customers remain responsible for information supplied by their end users.

 

4. Use Restrictions

 

Customers may not:

• Reverse engineer or decompile the platform
   

• Attempt to access source code
   

• Use the platform for fraudulent or harmful activities
   

• Interfere with or disrupt the Services
   

• Use the Services to harass or harm others
   

• Circumvent security measures
   

• Modify or create derivative works
   

Unauthorized use may result in termination.

 

5. Payment and Billing

 

Subscriptions are billed in accordance with the Customer’s chosen plan. Customers agree to pay all fees due and authorize Breesy or its payment processor to charge the provided payment method.

Fees are non-refundable except where required by law.

 

6. Intellectual Property

 

All content, code, design elements, trademarks, and intellectual property associated with Breesy remain the exclusive property of Breesy LLC.

Customers may not reproduce, distribute, or create derivative works without written permission.

 

7. Integrations

 

Customers may enable integrations with third-party systems. By enabling an integration, the Customer grants Breesy permission to access relevant data solely to provide the integration’s functionality.

Breesy is not responsible for third-party system failures, outages, or data handling practices.

 

8. Data Protection & Privacy

 

Breesy handles data in accordance with its Privacy Policy (www.breesy.ai/privacy). Customers authorize Breesy to process Customer Data and End User Data as described in that Policy.

 

9. Confidentiality

 

Each party agrees to maintain the confidentiality of non-public information received from the other party. Confidential information may be disclosed when required by law.

 

10. Service Availability

 

Breesy aims to provide reliable and continuous service but does not guarantee uninterrupted availability. Maintenance windows, outages, or third-party disruptions may affect service performance.

 

11. Disclaimer

 

The platform is provided “as is” without warranties of any kind, express or implied. Breesy disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

 

12. Limitation of Liability

 

To the fullest extent permitted by law:

• Breesy shall not be liable for indirect, incidental, special, consequential, or punitive damages.
   

• Breesy’s total liability shall not exceed the fees paid by the Customer in the preceding 12 months.
   

 

13. Termination

 

Breesy may suspend or terminate services if:

​

• A Customer violates these Terms
   

• Breesy suspects fraud, abuse, or security risk
   

• Payment obligations are not fulfilled
   

Customers may terminate by canceling their subscription.

 

Upon termination, Customer access ends, and Breesy may delete stored data according to retention policies.

 

14. Governing Law

 

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

 

15. Changes to the Terms

 

We may update these Terms at any time. Updates become effective upon posting. Continued use of the Services constitutes acceptance of revised Terms.
